An appeals court sitting in Abuja on Friday overturned a court ruling nullifying the election of Ademora Adeleke as governor of Osun state.

The court also ruled that the sum of N500,000 was awarded to the All Progressive Congress (APC) and its designee Gboyega Oyetola.

During sentencing, the judiciary ruled that the preponderance of evidence that the election was over-voted rested with the petitioners.

The court also argued that "a party alleging violations of election law must prove its allegations without merely alluding to the other party's weaknesses."

Judge Mohammed Shaibu has handed down the verdict, overturning the state court's ruling that invalidated the results of the July gubernatorial election. A three-member committee reversed the court's order and ordered Adeleke's return certificate to be revoked and issued to his predecessor, Oyetola, a candidate for the All Progressive Party Congress.

After the Independent National Electoral Commission declared Adeleke the winner of the election, the Osun Court annulled Adeleke's victory and confirmed that Guboyega Oyetra of the All Progressive Congress was the true winner of the election.

INEC said Adelke cast his 403,371 votes to defeat his APC's then-incumbent governor Adegbo Yega Oyetra, who received 375,027 votes.

However, Oyetola and his APC rejected the poll results and took them to court.

On January 27, 2023, a court led by Justice Tertse Kume annulled his Adeleke victory and declared Oyetola the winner of the election.

Minority verdict by Judge B. Ogbuli confirmed that Adeleke was the winner of the vote.

Unhappy with this, Adeleke and his PDP went to the Court of Appeals.

An appeals court heard his appeal on March 13 and reserved its judgment.

But an appeals court on Friday overturned the court's ruling, confirming Adeleke as the true winner and governor of Osun state.
