Osun Governorship: Court of Appeal reserves judgment in Adeleke's case

 On Monday, an appeals court in Abuja reserved judgment in an appeal by People's Democratic Party (PDP) leader Ademora Adeleke against a ruling annulling his election as governor of Osun state.


His three-person committee, headed by Judge M.F. Shuayb, the last governor, appeared for Mr. Gboyega Oyetola. , said the verdict would come at a later date. will be announced.


According to reports, while Adeleke is the plaintiff, Oyetola and All Progressives Congress (APC) are the first and his second defendants in the complaint, identified as: increase.

However, INEC, represented by SAN's Paul Ananaba, and PDP, represented by SAN's Alex Iziyon, did not file suit in this case.


The Court of Appeal will also hear mutual appeals from PDP, INEC and Oyetola.


It was reported that on Jan. 27, Osun Governor's Court of Appeals annulled his July 16, 2022 election and elected Adeleke of the PDP as governor. INEC declared Adeleke the winner after receiving a total of 403,371 votes.


He is said to have won 17 of his 30 local governments in the state.


However, a commission led by Judge Terste Kume annulled the election in its ruling, declaring the APC's Gboyega Oyetola the rightful winner of the election.


The court ordered INEC to revoke the return certificates of Adeleke and his representative, Cora Adeussi.


However, I ordered Oyetola to issue a return receipt instead. Judge Kume found that the gubernatorial election was not held in accordance with Nigeria's electoral law.


The court also noted that the gubernatorial election was marked by overvoting.


After deducting extra votes, Oyetola said he cast 314,921 votes in the election.


The court therefore ordered Oitra back as governor of Osun state.


 INEC said in previous results that Oitra said in his LGA of 13 on July 16, 2022, he won the gubernatorial election with 375,027 votes. Fifteen candidates contested the election, which was hotly contested between Adeleke and Oyetra.


Former governor Oitra, in his petition, claimed the election was marked by overvoting at 749 polling stations.


He also alleged that Adeleke falsified the educational background he had submitted to the NEC to run for election.


The court will open in August 2022, just weeks after the gubernatorial election.


Oyetola and his APC were the plaintiffs in the lawsuit with Latif Fagbemi (SAN) and Akin Orjimi (SAN) as lead counsel. INEC was the first defendant, Adeleke was the second defendant and PDP was the third defendant. (South)
